The Supreme Court on Monday turned down the Trump administration’s bid to set aside ballots from 20,000 California voters the administration alleges may not be citizens, the Los Angeles Times reported. The justices dismissed the emergency appeal without comment or dissent. The order said: “The application for injunction pending appeal presented to Justice Kagan and by her referred to the Court is denied.” Solicitor General D. John Sauer had asked the court to “segregate” the ballots before they were processed and counted. The Associated Press, on its live blog Monday evening, also reported that the court rejected the push to set the ballots aside.
The Times reported that the administration had already lost before a federal judge in Los Angeles and twice at the 9th Circuit. Those judges said the Constitution reserves power over elections to the states and Congress, not the executive, and that the complaint came too late for this election. California officials have said the list is unreliable and likely includes citizens. This note does not print a new count of how many of the 20,000 ballots were already in the tally.
The application for injunction pending appeal presented to Justice Kagan and by her referred to the Court is denied.
The photograph is May 4, the Justice Department seal on a podium in Washington. Julia Demaree Nikhinson made it for the AP. It is not Monday’s order. No justice is in the frame.
